KEY STANDARD FORM CONSTRUCTION CONTRACTS IN SOUTH AFRICA

This edition of our newsletter examines the three standard form contracts that dominate the construction landscape in South Africa, namely the JBCC, GCC and FIDIC. Each of these contracts serves a distinct purpose within the industry and reflects a different approach to procurement, risk allocation and contract administration.

JBCC

1) THE JOINT BUILDING CONTRACTS COMMITTEE (JBCC)

The JBCC Principal Building Agreement is the most commonly utilised standard form contract for private building projects in South Africa. It is particularly prevalent in residential projects, residential estates, commercial office developments, retail centres and mixed-use projects.

The JBCC framework is designed primarily for traditional procurement models, where the employer appoints a professional team to design the works and a contractor to execute them. Its structure reflects a balance between commercial practicality and procedural discipline, making it suitable for projects requiring formal contract administration.

GCC

2) GENERAL CONDITIONS OF CONTRACT FOR CONSTRUCTION WORKS (GCC)

Unlike the JBCC, which is principal agent-driven and prevalent in private building projects, the GCC is engineering-focused and structured to accommodate technically complex infrastructure works. Its framework reflects the realities of civil construction, where quantities may vary, ground conditions may be uncertain, and project execution often requires ongoing technical assessment.

FIDIC

3) INTERNATIONAL FEDERATION OF CONSULTING ENGINEERS (FIDIC)

Published by The International Federation of Consulting Engineers, FIDIC contracts are widely used across Africa, Europe, the Middle East and Asia. They are particularly common in large-scale infrastructure, renewable energy developments, mining projects and cross-border construction ventures.


The appeal of FIDIC lies in its international uniformity and detailed procedural mechanisms.
